How do dismissal and appeal cases work at Southeastern College?

Southeastern College operates Florida campuses including West Palm Beach, which is the main campus, and Miami Lakes. It is a private for-profit institution running nursing and allied-health programmes, and it was formerly Keiser Career College — the same corporate lineage as Keiser University, which matters when reading its enrolment documents, because the drafting habits are shared.

This is a private institution, so it is not a state actor: the Fourteenth Amendment does not reach it, and Fla. Stat. section 1006.60(3) — which gives students at Florida’s public colleges and state universities a legal representative who may question witnesses — does not apply. What governs is the school’s own published policy, enforced as a contract. In Florida that is not weak: Sharick v. Southeastern University of the Health Sciences establishes that an institution which departs from its own procedures can face real damages.

The arbitration clause, and the asymmetry inside it

Southeastern’s enrolment agreement compels AAA Commercial arbitration, and its fee-shifting provision runs only to the school. That is a one-way fee clause: the college can recover its costs from a student who loses, and a student who wins recovers nothing by the same route.

Two features of that deserve attention. The choice of the AAA Commercial rules rather than the consumer rules is not cosmetic. The consumer rules exist precisely to cap what an individual can be made to pay and to constrain forum and fee allocation in disputes between a business and a person. Selecting the commercial rules for a dispute between a nursing school and its student invites the argument that the wrong rule set has been designated for the relationship the contract actually describes. And a one-way fee clause deters meritorious claims independently of their merit, because the downside is asymmetric before a single fact is examined.

None of that means the clause is unenforceable, and it would be irresponsible to promise otherwise. It means the clause has to be read and reckoned with at the start rather than at the end, and that whether every term survives scrutiny is a real question rather than a foregone conclusion. It also raises the value of the internal process considerably: where the contractual exit carries asymmetric cost, the appeal inside the college is where a case is most likely to be resolved, and it deserves proportionate effort.

Which makes the internal appeal the main event

That conclusion is practical rather than rhetorical. The internal submission has to do three things at once: establish the factual account with contemporaneous documents; identify the specific published provision the college did not follow; and put the college on notice in writing that it is being held to its own procedure.

The third of those matters even where the appeal fails. A procedural departure raised at the time, and answered inadequately, is the material that makes a Sharick claim or an unconscionability argument viable later. An appeal written as a request for leniency generates none of it. An appeal written as a record does.

Routes the arbitration clause does not close

Worth stating clearly, because students commonly read an arbitration clause as the end of every avenue. It is not.

An arbitration agreement does not bar an administrative complaint to the U.S. Department of Education’s Office for Civil Rights, which handles Section 504, ADA, Title IX, Title VI and retaliation complaints. It does not bar a complaint to the institution’s accreditor, which is concerned with whether the college follows its own published policies. It does not bar a complaint to the Florida Commission for Independent Education, which licenses independent postsecondary institutions in this state. And it does not bar a complaint to the Florida Board of Nursing concerning an approved nursing programme. Those are all live, and none of them is a lawsuit.

One piece of Florida-specific context. Under Fla. Stat. section 464.019(5)(a)1 a nursing programme’s first-time NCLEX passage rate must be within 10 percentage points of the national average for comparable programmes, and section 464.019(5)(a)2 puts a programme below that floor for two consecutive years at risk of probation and loss of approval. A programme under that pressure has an institutional interest in who sits the exam, because a first-time passage rate can be improved by graduating fewer of the students judged least likely to pass. That is not unlawful, and it does not explain any particular dismissal, but it justifies examining the documents closely rather than accepting a progression decision at face value. For reference, Southeastern’s West Palm Beach associate-degree code recorded a 47.62% first-time passage rate in 2025 across 21 candidates, against a statutory benchmark of 76.05%.

What should you do first?

Find your enrolment agreement and read the arbitration clause before deciding how far you want to take a dispute — the one-way fee provision is the part to understand. Get the catalog edition that governs your cohort. Preserve graded work, clinical evaluations, attendance records, and any accommodation request with the college’s reply. Diary the appeal deadline on the shortest available reading. And note that the OCR, accreditor, Commission for Independent Education and Board of Nursing routes remain open regardless of what the enrolment agreement says about arbitration.

The other Florida nursing and health-sciences schools

Florida’s standalone nursing and health-sciences colleges differ sharply in what their own paperwork permits. Some bar a lawyer from the room entirely, some compel arbitration in another state, and some publish no appeal deadline for the student at all while binding themselves to one. Those provisions, not the school’s reputation, decide how a dismissal case runs.
