PHSC North Campus Brooksville Student Defense Lawyer

Pasco-Hernando State College is named for two counties, and the federal court system divides it along exactly that line. The North Campus in Brooksville is in Hernando County, which Middle District of Florida Local Rule 1.04(a) assigns to the Ocala Division. PHSC’s West, East and Porter campuses are in Pasco County, assigned to the Tampa Division. Same district, different courthouse, and the college’s own name contains both answers.

The Ocala/Tampa line runs through the college

Middle District Local Rule 1.04(b) requires an action to begin in the division to which it is most directly connected. For a PHSC student that turns on which campus the events happened at, not which campus the student considers their home campus. A nursing student taking classes at one campus and clinical hours at another has a genuine question to answer before filing, and it is better answered at the outset than on a motion to transfer.

Two things follow from that. First, the campus a case arises at — not the address on the college’s letterhead — decides where a federal suit belongs, because 28 U.S.C. section 1391(b) lays venue where a substantial part of the events occurred. Second, no campus in the Florida College System publishes its own student conduct code, so the rules that decide a dismissal here are the college-wide code plus whatever program handbook governs the course of study. Those two documents often disagree, and the handbook is usually what the program actually applies.

Nursing at the North Campus

PHSC is reported to deliver nursing instruction at the North Campus, though the college does not state the program’s campus siting plainly — worth confirming for the particular cohort before relying on it. Nursing is where Florida College System dismissals concentrate. Those decisions are made under the nursing program handbook rather than the college-wide conduct code, and the handbook is where automatic dismissal, progression limits and clinical-performance rules live. Where the two documents differ, the handbook is what the program applies — but the college code’s appeal route should be preserved anyway rather than abandoned. Florida NCLEX pass rates by program, and what Fla. Stat. section 464.019(5) does when a program falls below the statutory floor, are set out on the Florida nursing program pass-rate page.

This is a public college, so Fla. Stat. section 1006.60(3) applies in full — including subsection (3)(g), the right to be accompanied by counsel at a disciplinary proceeding, and subsection (3)(b), which puts the burden on the college rather than the student. What those rights do and do not include is set out on the Florida student defense page.

What can a student defense lawyer do here?

  • Fix the division before filing — Brooksville is Ocala, not Tampa.
  • Obtain the nursing or allied-health program handbook, which is the document that actually decides a progression dismissal.
  • Preserve both the program appeal and the college-wide appeal; they are not alternatives.
  • Keep the 30-day certiorari window under Fla. R. App. P. 9.100(c) open while the internal appeal runs.

Every school writes its own dismissal, appeal and conduct rules, and the filing deadlines are rarely the same from one campus to the next. These pages set out the procedure at other Florida colleges:

Common questions about PHSC North Campus cases

Which courthouse hears a PHSC North Campus case?

The Middle District of Florida, Ocala Division. Hernando County is assigned to Ocala by Local Rule 1.04(a), while PHSC’s Pasco County campuses are assigned to Tampa.

My classes were in Brooksville and my clinical was in Pasco. Which division?

That depends on where the substantial part of the events occurred. If the decision, the instruction and the clinical placement are split across counties, more than one division may be proper, and the choice should be made deliberately under Local Rule 1.04(b).

Is a nursing dismissal handled under the student conduct code?

Usually not. Progression and clinical-performance dismissals come from the nursing program handbook, which imposes rules the college-wide code never mentions. Both appeal routes should be preserved.

Does the North Campus have its own conduct code?

No. PHSC’s college-wide code applies at every campus, together with the program handbook for your course of study.

Tell me what happened

Four facts start the conversation — your school and program, what happened and where it stands, any deadline, and whether you are still enrolled. What comes back: whether the matter fits this practice and, where one can responsibly be given, a preliminary figure. I read every message myself, and you hear back the same business day — the next one if you write in the evening or on a weekend.
