Overview

An FIU student defense lawyer works in a setting that differs from most Florida campuses in one legally significant way. Why AI-detection evidence is especially weak here

A 2023 piece in the journal Patterns, GPT detectors are biased against non-native English writers, tested seven detectors and found they misclassified a majority of TOEFL essays written by non-native English speakers as AI-generated. The mechanism is straightforward: these tools score text partly on how statistically predictable the writing is, and careful second-language writing tends to be more predictable than native writing. Vanderbilt University disabled Turnitin’s AI detector in 2023 for related reasons.

At an institution where a large portion of the student body fits that profile, an allegation resting on a detector score has a documented reliability problem before anyone examines the specific paper. Immigration status raises the stakes

FIU enrolls a significant international student population, and for a student on an F-1 or J-1 visa a disciplinary suspension is not only an academic problem. Loss of full-time enrollment carries immigration consequences on a short timeline, and those consequences can arrive before any appeal is resolved. The campus strategy and the status question have to be handled together from the beginning rather than sequentially, including with immigration counsel where that is warranted.

Many policies say a score alone is not sufficient, and the published research shows high false-positive rates for non-native English writing in particular. Whether it carries the day depends on your school’s written policy and on what else is in the file, but where the score is the only evidence its error rate becomes the central issue.

I am an international student. What happens to my visa if I am suspended?

A break in full-time enrollment has immigration consequences on a short timeline, and they can take effect before an appeal concludes. That needs to be evaluated alongside the disciplinary strategy, not after it, and often with immigration counsel involved.

Should I explain in the interview that English is not my first language?

The point is usually stronger in writing, with documentation and the research attached, than as an explanation offered under pressure in an interview. How and when to raise it depends on the facts and on what the file already contains.
