Embry-Riddle Prescott Student Defense Lawyer
Embry-Riddle’s Prescott campus produces a category of student case that most universities do not generate at all: matters where a disciplinary or academic outcome is entangled with flight training, a medical certificate, a security clearance path, or a professional credential the student has already begun to build. A conduct finding that would be an inconvenience at a general-purpose university can, at Prescott, interrupt a flight block, delay a certificate, or surface later in an aviation or federal employment background review. Overview
Embry-Riddle Aeronautical University is private, and its Prescott campus, established in 1978, is a residential campus in Prescott, Arizona serving roughly 3,300 undergraduate and graduate students on a 539-acre site. Private status controls the legal theory. Embry-Riddle is not a state actor, so there is no Fourteenth Amendment claim available. Goss v. Lopez, 419 U.S. 565 (1975), and the academic-deference cases that follow it, Board of Curators of the University of Missouri v. Horowitz, 435 U.S. 78 (1978), and Regents of the University of Michigan v. Ewing, 474 U.S. 214 (1985), govern public institutions. At Prescott the operative documents are the student handbook, the academic catalog, the honor code, and the flight and department policies, and those documents are the contract.
That means the analysis is textual. What did the university promise about notice, evidence, hearings, advisors, and appeals, and did it do those things? A published procedure that was skipped is provable from the institution’s own paper, which is usually a stronger position than a general fairness argument. Where Embry-Riddle Prescott cases come from
The recurring sources are academic integrity allegations in engineering and science coursework, where the evidence is often similarity software or an instructor’s judgment about collaboration on problem sets; residential and alcohol conduct matters on a campus where most students live on site; Title IX proceedings; and academic standing disputes in demanding technical sequences. The campus houses colleges covering aviation, engineering, and business, security and intelligence, and its flight program operates a Cessna 172 and Diamond DA42 fleet out of the adjacent airport, Ernest A. Love Field.
Flight students face a compounding problem. A suspension or a removal from flight status does not merely pause a semester; it interrupts currency, delays checkrides, and can push a student out of a training sequence that is expensive to re-enter. Where the underlying matter is conduct rather than airmanship, the collateral training consequence is frequently a stronger negotiating point than the merits of the charge, and it should be raised deliberately rather than as a complaint. Which process you are in matters
Embry-Riddle separates academic integrity, student conduct, Title IX, and academic standing, and it maintains department-level flight and program policies on top of the university-wide documents. The track determines the deadline, the decision-maker, the standard of proof, whether an advisor is permitted, and what that advisor may do. A student who responds to a flight department action as though it were a conduct charge, or the reverse, loses the argument that actually mattered.
Identify your track first: academic misconduct and honor code, Title IX, or academic dismissal and suspension. Where a decision is disciplinary in substance but issued under an academic or programmatic label, that mismatch is worth stating plainly, because the procedures owed to you differ between the two.
What to do first
Pull the current student handbook, honor code, catalog, and any flight or department policy that applies to you from the university’s own site rather than relying on any summary, including this one. In a contract case the operative version is the one in effect during your enrollment period, so save the document as it exists now rather than assuming it will still read the same way when you need it.
Then calendar the deadline in writing, request your file, and preserve drafts, code and problem-set version history, messages, training records, and instructor communications. Do not sit for an interview or provide a written statement before you understand what the university claims to have. Adding a dishonesty allegation based on what a student said during the process is a common move in these systems, and it is often easier to prove than the original charge.

Common questions
Will a campus conduct finding affect my aviation career?
It depends on the finding and on what you will later be asked to disclose. Campus discipline is not the same thing as an enforcement action by a federal agency, and the two should not be conflated. But airline, corporate, and government applications commonly ask about school discipline, and security-sensitive positions ask broadly. The wording of the resolution and any transcript notation is what a future reader sees, which is why the language is worth negotiating even when the outcome itself is not going to change.
The university removed me from flight status pending an investigation. Can it do that?
Interim measures of that kind are usually authorized somewhere in the handbook or the flight department policy, and the question is whether the stated conditions for imposing one were met and whether the promised review of that measure actually happened. Interim actions are frequently imposed quickly and reviewed slowly, and a prompt, specific written request for the review the policy already provides is often more effective than a challenge to the underlying charge.
Does Embry-Riddle’s Arizona location change which policies apply?
Prescott is a campus of a university headquartered elsewhere, and institutional accreditation runs through the home campus in Florida. Practically, that means some documents you receive may reference offices, officials, or resources that exist at another site, and some decisions may be reviewed outside Prescott. Where the handbook you were given does not match the structure you are actually dealing with, that gap should be documented rather than quietly navigated around.
