FERPA & Education Records

Access, correction, and disclosure of education records.

Overview

The Family Educational Rights and Privacy Act (FERPA) gives eligible students rights to inspect their education records, seek correction of inaccurate records, and limit non-consensual disclosure. It is a powerful tool for getting the record and for leverage in a broader dispute.

Importantly, FERPA does not provide a private right to sue; it is enforced through a complaint to the U.S. Department of Education. I use FERPA strategically — to obtain records and apply pressure — rather than as a stand-alone lawsuit.

What I can help with

  • Requesting and reviewing the complete education record
  • Seeking correction of inaccurate or misleading records
  • Addressing improper disclosures of student information
  • Using records strategically in a disciplinary or academic matter
  • Advising on FERPA complaints to the Department of Education
  • Integrating records strategy into the broader case
